Accused of patent infringement again! Baolaite recently announced that the company has been sued for patent infringement by Shenzhen Mindray Biomedical Electronics Co., Ltd. (referred to as Mindray Medical or Mindray Company).

3 cases with a claim of 30 million yuan

On the evening of August 14th, Baolaite disclosed that the company had recently received legal documents such as subpoenas and "Civil Complaints" served by the Intermediate People's Court of Fuzhou City, Fujian Province, involving three patent dispute cases. In three cases, Mindray Medical claimed a total of 30 million yuan from Baolaite.

Specifically, the plaintiffs in the three cases are all Mindray Medical, while the first and second defendants are Baolaite and Nanping Chenrui Medical Equipment Co., Ltd. (hereinafter referred to as "Chenrui Company").

In Case 1, Mindray Medical believes that it and Shenzhen Mindray Technology Co., Ltd. are the patent holders of the invention with the patent number ZL201780051006.3 and the name "Medical Equipment". Baolaite manufactures, sells, and promises to sell the P1 model of monitors, while Chenrui Company sells the aforementioned models of monitors, which fall within the protection scope of Mindray Medical's patent rights. Baolaite and Chenrui Company shall bear legal liability for patent infringement.

The invention patents involved in Cases 2 and 3 are also related to the monitor. In both cases, Mindray Medical did not request economic compensation from Chenrui Company, but instead claimed 10 million yuan from Baolaite separately.

Mindray Medical is not the first to sue Baolaite

It is reported that this is not the first time that Mindray Medical has sued Baolaite. In April of this year, Baolaite disclosed that Mindray Medical has filed two patent infringement lawsuits against it, claiming a total of 10 million yuan.

Case 1:

In Case 1, Mindray Biotech believes that the P1 patient monitor manufactured, sold, and promised to be sold by Baolaite infringes on its design patent with patent number 201630419447.2 and the name "Monitor (N1)".

Therefore, Mindray Biotech requests the court to order the two defendants mentioned above to immediately cease their infringing behavior and claim 5 million yuan from Baolaite. From the announcement, it can be seen that Mindray Biological did not demand economic compensation from the defendant, Nanping Chenrui.

Case 2:

In Case 2, Mindray Bio sued that the patient monitor model P18 manufactured, sold, and promised to be sold by Baolaite infringed on its design patent number ZL201630126309.5 and the name "monitor".

Mindray Biotechnology requests the court to order Baolaite to immediately stop manufacturing, selling, and promising to sell the patient monitor model P18, destroy the finished and semi-finished products of the inventory product, destroy the advertisement and promotional printing materials of the product, delete the promotion and advertising of the product on the internet, and claim 5 million yuan; Defendant 2, Nanping Chenrui, immediately stopped selling patient monitors with model P18.

In two appearance patent litigation cases, Baolaite was claimed a total of 10 million yuan.
