2015 年6月12日，一家營業處所設立於美國德州 的專利授權公司Script Security Solutions, L.L.C. (下稱Script)，向美國德州東區聯邦地院提起專利侵權告訴，控告Panasonic北美分公司Panasonic Corporation of North America (下稱Panasonic)所製造販賣之居家監控系統產品Home Monitoring System，直接與間接侵害了Script所擁有的兩項專利權利，其發明內容為偵測一客體動作並提供動作相關資訊的系統與方法。
本 案兩件系爭專利為美國專利編號US 6,542,078以及US 6,828,909( 下稱’909專利)，名稱均為「可攜式行動偵測與警示系統及方法（Portable motion detector and alarm system and method）」，分別於2003年4月1日以及2004年12月7日核發，發明人均為Henry J. Script與Michael H. Script，後者為前者在申請時的部分連續案(continuation-in-part)。
在 與本案同日，Script向本案相同法院提起另外5件專利侵權告訴，控告販賣Insteon與Oplink等品牌居家監控系統產品之購物網站Amazon 與Best Buy、製造販賣居家監控系統產品的Time Warner Cable Enterprises LLC(下稱TWC)、Verizon Communications, Inc.(下稱Verizon)、Vtech Communications, Inc.等公司，直接與間接侵害了本案兩件系爭專利，而在控告TWC與Verizon之案件中，Script則多主張了US 7,113,091專利( 下稱’091專利)權利。在本案訴狀中，Script在就其間接侵權之主張提供補充說明以及訴之聲明(prayer for relief)的部分，均將系爭專利’909專利誤植為’091專利，足見其起訴品質之不佳。
依 據美國專利商標局(USPTO)之專利轉讓資料，本案系爭專利權利於2015年1月8日，從系爭專利發明人之一Michael H. Script擔任執行長的Guardit Technologies, LLC公司轉讓給專利授權公司Empire IP LLC (下稱Empire IP)。Empire IP在其網站上所揭露、其擁有權利的專利組合技術領域，其中便包括「行動偵測警示系統(Motion Detection Alarm Systems)」一項，而雖然其未揭露該專利組合中個別專利之編號，但Empire IP所描述該專利組合之技術特徵為「用於偵測一客體動作並回應所偵測到動作傳送一無線信號的系統與方法(systems and methods for detecting movement of an object and transmitting a wireless signal in response detecting such movement)」，與本案系爭專利可以說是相同。
根 據美國德州的法人登記資料，Script於2015年2月17日登記設立。RPX Corporation所建置NPE資料庫，則是將本案原告Script列為Empire IP的子公司。根據前述資料庫，Empire IP目前有32家已知的子公司，包括MD Security Solutions LLC、Stone Basket Innovations LLC、CDR Printing LLC、Speed Monitoring Technologies LLC等，而Empire IP則是透過這些子公司來起訴專利侵權之訴。
而 在2015年3月13日，Script曾向本案相同法院提起11專利侵權之訴，控告Vivint, Inc.、AT&T Digital Life, Inc.、Comcast Corporation等公司的居家監控系統產品，侵害本案系爭專利權利。(1290字；表3)
